Welcome to Luce Haven Boutique. These Terms of Service (“Terms”) apply when you visit our website, purchase a product, download a digital product, or otherwise use our services. By using our store, you agree to these Terms. If you do not agree, please do not use the store.

  1. OUR STORE

Luce Haven Boutique offers physical merchandise, print-on-demand products, supplier-fulfilled or drop shipped products, and digital products. Our online store and checkout services are powered by Shopify.

You must be legally able to enter into a binding agreement to make a purchase. If you allow a minor to use this store, you are responsible for their activity and purchases.

  1. PRODUCTS AND AVAILABILITY

We make reasonable efforts to display product descriptions, colors, measurements, materials, prices, and images accurately. However, colors and appearance may vary depending on your screen, production process, or supplier.

Products, prices, designs, quantities, and availability may change without notice. We may limit or discontinue products at any time.

Some physical products are created or fulfilled by third-party print-on-demand and drop shipping suppliers. Items from the same order may be produced by different suppliers and arrive in separate packages.

  1. ORDERS

Submitting an order does not guarantee acceptance. We may refuse, limit, or cancel an order because of inventory problems, incorrect product or pricing information, supplier limitations, suspected fraud, payment issues, shipping restrictions, or other reasonable business concerns.

If we cancel an order after payment has been collected, an appropriate refund will be issued to the original payment method.

You are responsible for providing complete and accurate billing, shipping, contact, and payment information. Luce Haven Boutique is not responsible for delivery problems caused by an incorrect or incomplete address supplied by the customer.

  1. PRICES, BILLING, AND PAYMENT

Prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, shipping costs, and other charges will be displayed during checkout when required.

Prices may change without notice. A price change will not affect an order that has already been accepted.

Payments are processed through Shopify and available third-party payment providers. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize all charges connected with your order.

  1. PRINT-ON-DEMAND AND DROP SHIPPED PRODUCTS

Certain products are made, packaged, and shipped by independent suppliers after an order is placed. Production and delivery times may vary by product and supplier.

Because some items are made to order, changes or cancellations may not be possible once production has started. Slight variations in color, placement, size, stitching, printing, or packaging may occur and are not necessarily considered defects.

Although third-party suppliers fulfill these products, customers should contact Luce Haven Boutique regarding order questions or problems.

  1. SHIPPING AND DELIVERY

Processing and delivery dates are estimates and are not guaranteed. Shipping may be affected by supplier processing times, carriers, weather, holidays, customs, incorrect addresses, and other circumstances outside our reasonable control.

Multiple items in one order may arrive separately. Tracking information will be provided when available.

  1. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, replacements, exchanges, refunds, and cancellations are governed by our Refund Policy.

Print-on-demand, personalized, made-to-order, final-sale, and digital products may have different eligibility requirements. Nothing in these Terms limits any consumer rights that cannot legally be waived.

  1. DIGITAL PRODUCTS

Digital products are delivered electronically. Customers are responsible for providing a correct email address and ensuring their device and software can open the purchased files.

Unless a product listing or written license clearly grants additional rights, digital products are licensed to the purchaser for personal, noncommercial use only. Digital files may not be copied, shared, distributed, uploaded, resold, or commercially used without written permission.

Products that include Private Label Rights, Master Resell Rights, or other commercial rights will include a separate written license explaining exactly what is permitted. The specific product license controls if it conflicts with this general section.

Download links, files, passwords, and access information may not be shared with unauthorized individuals.

  1. HEALTH AND WELLNESS INFORMATION

Fitness, meal-planning, wellness, and similar digital products are provided for general educational and informational purposes only. They are not medical advice, diagnosis, or treatment and do not replace advice from a qualified healthcare professional.

Customers should consult an appropriate healthcare professional before beginning a new exercise, nutrition, or wellness program, especially if they have a medical condition, injury, are pregnant, take medication, or have other health concerns.

Individual results vary. Luce Haven Boutique does not guarantee specific health, fitness, weight-loss, or wellness results.

  1. INTELLECTUAL PROPERTY

The Luce Haven Boutique name, branding, website content, graphics, original product descriptions, and original digital materials belong to Luce Haven Boutique or are used with permission.

You may not reproduce, modify, distribute, publish, sell, or commercially use this material without permission, except when a written product license specifically allows it.

  1. PROHIBITED USES

You may not use our store or products to:

• Violate any law or regulation
• Commit fraud or provide false information
• Infringe intellectual-property or privacy rights
• Introduce viruses, malware, or harmful code
• Interfere with store security or operation
• Collect information about others without authorization
• Attempt unauthorized access to an account, system, or data
• Harass, threaten, abuse, or harm another person
• Copy, scrape, or exploit store content without permission

We may suspend or terminate access for prohibited conduct.

Our store may use or provide links to Shopify, payment processors, suppliers, fulfillment companies, shipping carriers, apps, social-media platforms, and other third parties.

Third-party services are governed by their own terms and policies. We are not responsible for third-party websites or services except where required by law.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the store, its content, and its services are provided “as is” and “as available.”

We do not guarantee that access will always be uninterrupted, secure, or error-free. We do not guarantee that every description, image, or other piece of information will be free from minor errors.

This section does not exclude warranties or consumer rights that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Luce Haven Boutique will not be responsible for indirect, incidental, special, consequential, or punitive damages resulting from your use of the store or products.

Our total liability relating to a product or order will not exceed the amount you paid for the product involved in the claim.

These limitations do not apply where prohibited by law.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to protect and hold Luce Haven Boutique harmless from claims, losses, liabilities, or expenses arising from your violation of these Terms, misuse of the store, or infringement of another person’s rights.

  1. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

  1. NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

  1. TERMINATION

We may suspend or terminate access to the store when conduct violates these Terms or threatens the store, our customers, suppliers, or others.

Terms that should reasonably remain effective after termination will continue to apply.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Customers retain any mandatory consumer protections provided by the laws that apply to them.

  1. CHANGES TO THESE TERMS

We may revise these Terms when our products, services, suppliers, or legal obligations change. The revised Terms will be posted with an updated date.

Your continued use of the store after revised Terms become effective means you accept those changes.
